Quasi-Judicial Hearing Regarding West Side Emergency Spillway Case

LEGAL NOTICE

Notice is hereby given that a Quasi-Judicial Hearing will be held, before the Moore County Board of Adjustment at 4:00 pm on Wednesday, October 28, 2020 in the Board of Commissioners’ Meeting Room, located on the second floor of the Historic Courthouse, 1 Courthouse Square, Carthage, NC, regarding the following case:

1.            Steven and Julia Vining have appealed the September 3, 2020 decision of the Moore County Planning & Transportation Director’s Zoning Violation Complaint determination that the use of the Emergency Spillway at Seven Lakes West located adjacent to 179 Morris Dr., Longleaf Dr. and Lake Auman Dam in West End, NC 27376 is not a violation of the ordinance. The Zoning Violation Complaint determination states, in part, that a zoning violation of the Moore County Unified Development Ordinance (UDO) does not exist because the Seven Lakes West Landowners Association has the right, title, authority, and regulation over the emergency spillway for the use of this lake and recreation area pursuant to the Declaration of Restrictive Covenants that were recorded in 1979 in Book 449, Page 662 of the Moore County Registry and any other Covenants and Declarations applicable to this neighborhood in Seven Lakes West.

The appeal application contends:

The ground for the appeal is that the Emergency Spillway owned by Seven Lakes West Landowners Association has allegedly created a new use changing from a road shoulder and emergency spillway for the Lake Auman Dam to an active recreation area, which the appeal contends is contrary to applicable zoning.

The subject property is identified as a portion of Parcel ID: 97000639 per the Moore County Tax Records. The property is located adjacent to 179 Morris Dr. and is the Seven Lakes West Landowners Association’s Emergency Spillway on Lake Auman Dam.
